General Field: Epidemiology

Position at the Time of Case Filing: Doctor

Country of Origin: Taiwan

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: Colorado

Approval Notice Date: March 1st, 2016

Processing Time: 8 days (Premium Processing Requested)

Case Summary:

A gifted doctor working in the field of epidemiology hired North America Immigration Law Group (WeGreened.com) to help him and his family attain green cards. We initially planned to file both EB-2 NIW (National Interest Waiver) and EB-1A (Alien of Extraordinary Ability) petitions for our client but cancelled the former when his EB-1A petition was approved.

Legal Approach:

We hit the ground running as soon as the contract was signed and returned to us. One of the first things we did was counsel our client to obtain recommendation letters from other influential epidemiologists. Six experts agreed to support our petition, one of whom wrote, “… the progress in our understanding of the associated factors of various diseases and illnesses represented in his research is priceless in terms of medical applications. As an elite member of his field, [Client] has become incredibly important to the continual improvement of medical care in the United States, and the continuation of his work is therefore a matter of national concern. [Client’s] work has benefitted the field as a whole and has therefore benefitted the medical care available to citizens of the United States.”

Besides strong recommendation letters attesting to the value of our client’s work to the United States, we also incorporated the following information into our EB-1A petition packet: the 216 citations gathered from our client’s 22 published journal papers, and the 8 times he conducted peer reviews for scientific periodicals. We also detailed our client’s research efforts on metabolic syndrome and cardiovascular issues.

Premium Processing & Approval Notice:

As our client chose to file his EB-1A petition under Premium Processing (PP), he received an approval notice from Nebraska Service Center 8 days after we filed the case on his behalf. Available only to EB-1 cases, PP is a viable option for petitioners who are unable or unwilling to wait between 4-9 months for the USCIS to adjudicate their case (action must be taken on cases filed under PP within 15 days). We are pleased that our client’s EB-1A case was approved, and we congratulate him on this milestone. Our firm recently filed I-485 applications (final step in the green card process) for our client and his family, and we join them in awaiting a favorable decision from the USCIS.
