Although our client was born in China, she does not have to wait for her priority date to become current before taking the final step towards her green card: the I-485 application. Seeing that her husband was born in Taiwan, the rules of cross-chargeability apply to her, meaning her I-485 application will be charged according to Taiwan’s quota and not China’s. In a nutshell, petitioners born in China whose I-140s were recently approved under the EB-2 visa category have to wait roughly several years for their priority date to become current before applying for their green card, whereas those from Taiwan can apply immediately.
