On April 3rd, 2013 we received another EB1A (Alien of Extraordinary Ability) for a non-research related professional in graphic design. (Approval Notice)
General Field: Graphic Design
Position at the Time of Case Filing: Graphic Designer
National Origin: Japan
Service Center: Texas Service Center
State Residing at the Time of Filing: New York
In this case our client was a renowned graphic designer whose works had been critically acclaimed. We set out to highlight this client’s achievements and qualifications. This client had made substantial contributions to the modern field of graphic design. Some of his major clients have included, Universal Music Group (UMG), Lacoste, Yamaha, Maxim magazine, Sony Pictures, Robert Geller, Saiseiko, NY Metrotours, Qualitas Candles, Le Bois, and Canon. Similarly notable, and on the individual/celebrity side of his contributions, this client had developed critical graphic designs via print, web and social media campaigns for Justin Bieber, Mariah Carey, Enrique Iglesias, Fefe Dobson, Mikami Chisako, and The Killers. Thus based on our client’s achievements in the field of endeavor – graphic design – in combination with their diverse contributions to the entertainment, media, fashion, and advertising industries at-large, we proved that this client had substantially benefited the United States prospectively through stimulating e-commerce, advancing social media campaigns, and bolstering the efficacy of corporate advertising, thereby resulting in an overall improved economic state via enriched initiatives in national industry and culture.
In addition, the client also made over 150% to 200% of the national average of similar professionals, as well as achieving a salary greater than the 90th percentile in relation to others in the field.
In the second part of the petition process we had to prove that our client had 1) a “level of expertise indicating that the individual is one of that small percentage who have risen to the very top of their field of endeavor,” and 2) “that the alien has sustained national or international acclaim and that his or her achievements have been recognized in the field of expertise.” It was in this section that we procured an extensive and detailed collection of recommendations from both individuals who have and have not had any relationship with our client. Many of these letters were from highly distinguished industry leaders in graphic design and corporate leaders who had employed our client in the past.
We also showed that our client’s work had a large contribution with respect to the e-commerce of the United States, one of the fastest developing industries and job-creators both internationally and domestically: “Over the next five years we forecast that aggregate E&M global spending will rise to $1.9 trillion in 2015, a 5.7 percent compound annual advance driven by economic growth, but masking the accelerating shift of spending from traditional to digital platforms. Currently digital accounts for 26 per cent of all spending but by 2015 we expect digital’s share to rise to 33.9 per cent.” Moreover, an individual from an independent advisory letter said this about our client: “While it is a relatively new art discipline, graphic design serves as the basis of almost all forms of media and is continually developing and growing. Quality commercial graphic design not only presents information in a way that is appealing, but also easy to understand. In doing so, good graphic design is essential for companies to draw in consumers. Mr. X’s considerable technical skill combined with his originality and unique perspective give him the ability to present products in a way that engage consumers. It is for this reason that Mr. X is one of the most in demand graphic designers of today. His work encompasses multiple mediums including webpages, print advertisements, store display design, and even t-shirts.” Both the independent advisory opinions in combination with our analysis of the e-commerce industry proved decisively that our client was more than qualified with respect to this last criterion.
Using this proven strategy, while correctly articulating the importance surrounding this client’s valued work, we at Chen Immigration Law Associates were able to secure approval for this petition on April 3rd, 2013.
